TERMS OF USE OF THE FLUXMED PLATFORM AND PROTECTION OF PERSONAL DATA (“Term”)
INTRODUCTION
This Term is offered by Core Consultoria e Serviços Ltda., a technology company based in Brasília/DF, registered with CNPJ nº 05.490.544/0001-00 which, from now on, will be referred to as “Core Consulting" or simply "us”.
THE Core Consulting is the sole and exclusive owner of the brands and domains associated with the so-called “Fluxmed”, “fluxmed.com.br”, fluxmed.cloud and coreconsulting.com.br. Therefore, it is the developer, owner of all material and immaterial rights of the “Fluxmed Platform” or simply ““Fluxmed“.
A "Fluxmed” is a platform for developing digital health services, in constant technological evolution, including and making new features available frequently. This implies constant updating of this Term, which will always be available on the Platform for reading, updating and understanding by the user from the Fluxmed Platform, i.e, YOU (or your legal representative).
YOU (or its legal representative), user of the Fluxmed Platform is a patient of the healthcare establishment that contracted the Fluxmed Platform to, through it, provide the YOU a health service. YOU is also a holder of personal data, a consumer who, through this Term, expresses his free, informed and unequivocal will and accepts the conditions for using the Platform Fluxmed through the Application or web.
PURPOSE AND ACCEPTANCE
This Term has the GOAL comply with the duty to inform YOU, about the indications and limitations of use, the purposes, the service channel for technical questions, your rights and obligations related to the use of the Platform Fluxmed.
Furthermore, through this Term we want to show our commitment to the General Personal Data Protection Law (Law No. 13,709/2018 – “GDPR”) and reinforce our duty with transparency and accountability by describing: the processing cycle of your personal data and sensitive personal health data, the legal basis adopted, the treatments carried out by Core Consulting and our performance as a Treatment Agent in relation to the healthcare establishment that YOU will interact through Fluxmed Platform.
By reading this Term YOU will also understand and need to agree that its acceptance is mandatory to use the Fluxmed Platform. If YOU do not agree with any item of these Terms YOU you will not be able to use the Fluxmed Platform because this Term is accession.
Since now, YOU you need to know that you can revoke your consent at any time and at no cost. In fact, the Fluxmed Platform allows to YOU manage your consent. This means that YOU will be able to manage with whom and with which healthcare establishments YOU allows your health data to be shared and viewed.
THE Fluxmed Platform was developed on the premise that YOU is the protagonist of your health and owner of your personal data.
As soon as YOU register on the platform, YOU need to know that YOU receive a user profile with a patient view, the features are centered on YOU. When YOU receive care at one or more healthcare organizations that also use the platform, be aware that the healthcare organization becomes the controller of your health information.
DESCRIPTION OF THE FUNCTIONALITIES OF THE FLUXMED PLATFORM AND LIMITATIONS OF USE
A "Fluxmed” is hosted in the cloud in Brazil and has features such as: storing electronic medical records, scheduling appointments, issuing electronic medical documents (prescription, ordering exams, certificates), carrying out teleconsultations via video. It also allows YOU view the entire access history of your health information whenever YOU you want, which is an additional security mechanism for YOU.
IN THE EVENT OF AN URGENCY OR EMERGENCY, SEEK THE IN-PERSON SERVICE, THE EMERGENCY CARE OR THE NEAREST AID CARE CLOSEST TO YOU.
CORE CONSULTING IS NOT THE HEALTH SERVICE PROVIDER. YOU MUST SEEK YOUR RIGHTS ONLY AT THE HEALTHCARE ESTABLISHMENT.
YOU HEREBY EXEMPT CORE CONSULTING FROM ANY LIABILITY RELATED TO THE PROVISION OF HEALTHCARE SERVICES.
CONSENT IS THE LEGAL BASIS ADOPTED BY CORE CONSULTING TO PROCESS YOUR HEALTH INFORMATION (art. 11, I of the LGPD
The processing of your health data by Core Consulting it must always be done with your specific and highlighted consent (art. 11, I of the LGPD), for your benefit and for the continuity of your assistance.
Through this Term YOU grants this consent to the health establishment that is providing your care through the Fluxmed Platform.
THE Fluxmed Platform allows to YOU manage your consent. This means that YOU will be able to manage with whom and with which healthcare establishments YOU allows your health information to be shared and viewed.
HOW YOUR HEALTH INFORMATION IS OPERATED BY FLUXMED
THE Fluxmed Platform operates your health information in the form of storing and processing clinical information charged by YOU (“user-patient”), eventually, and by healthcare professionals from a healthcare organization (“authorized-user”), for your benefit and assistance.
- Registration of personal identification data: for YOU register to Fluxmed Platform, application or web, YOU You will need to enter the following personal identification data to generate the login and password to access Fluxmed Platform:
- Full name
- Date of birth
- Birth sex
- CPF number
- Cell phone number
YOU you need to know that, to ensure your identification and to avoid fraud, the Core Consulting validates your data with the IRS, sends a validation token via SMS to your provided phone number or an email to validate your registration. Therefore, we request this information to YOU.
Do not provide inaccurate information about your identification, protect your password by not giving it to anyone, if you need people other than YOU have access to your health information, use the consent mechanisms available in Fluxmed applications.
After registration is complete YOU you can use the features of the Fluxmed Platform, manage your personal data and your health in the palm of your hand!
If requested by the healthcare establishment, the Core Consulting can process your health information in the form of tables, dashboards. This allows the healthcare facility to optimize population health management for its patients.
YOU You need to know that the LGPD prohibits processing for illicit or abusive discriminatory purposes.
CORE CONSULTING IS THE DATA OPERATOR
Core Consulting acts as Operator of data because it processes your personal data according to the purposes established by the healthcare establishment, which is the Controller of data.
While YOU is not attended to by a healthcare establishment through Fluxmed Platform YOU you can ask the Core Consulting to delete your registration data. YOU need to seek the channel for exercising LGPD rights before the health establishment where YOU was attended to.

STORAGE TIME
Unlike the healthcare establishment, the Core Consulting is not obliged to keep your personal data. Therefore, the platform provides the healthcare organization with mechanisms for extracting data controlled by it.
SECURITY MEASURES AND YOUR RESPONSIBILITIES

Once registered, YOU declare and agree that your data Login and password to access Fluxmed Platform are personal, and belong to YOU. YOU no may disclose or transfer your Login and password for anyone.
YOU is responsible for your personal registration data, regardless of whether they are validated by Core Consulting. This means that the Core Consulting will not be responsible for ensuring that YOU is the person who registered YOU The Fluxmed Platform.
THE Core Consulting nor will it be responsible for the security of your personal data shared by YOU in other environments such as email, Whatsapp or any other similar messaging systems.
All access to Fluxmed Platform are traceable, cannot be altered and can be viewed by YOU.
FINAL INSTRUCTIONS FOR PROPER USE OF THE APPLICATION AND LIMITS
When using the Fluxmed Platform YOU acknowledge and agree that the availability and operation of the Fluxmed Platform, like any information and communication technology, are subject to interruptions due to factors beyond the company's control. Core Consulting, including but not limited to:
- unavailability of electrical energy,
- internet signal failures and inadequate connection speed,
- scheduled maintenance,
- software failures under repair,
- environmental disasters.
In cases of interruptions due to scheduled maintenance, software failures or any other factor that affects the availability of the Fluxmed Platform, YOU You can take the following actions:
Check Announcements: There may be a notification indicating unavailability.
